Zurich Municipal is delighted to announce that the January 2012 edition of Court Circular is out today. Our popular customer publication keeps you up to speed with the latest court judgments affecting Public Services and the Civil Society.
From now on you will receive Court Circular in a newly designed, interactive email. We hope that this format is easier to read, as individual articles can now be accessed by a simple link.
Below are examples of some of the cases covered in this month’s issue:
- In Education we discuss a variety of liability issues. For example; when a young pupil injures himself on a treadmill, is the teacher’s negligence to blame due to a lack of instruction and supervision, or was it an unfortunate accident?
- Our Police customers may find the article on public order offences useful. Here we discuss the arrest of a suspect who used offensive language during a search. The question highlights whether the language used caused any actual harassment and distress to those around him, to justify such a prosecution.
- In our Occupier’s Liability section we focus on accidents occurring on an occupier’s property. This section touches on the circumstances which give rise to a duty of care being owed, the importance of giving correct evidence in case of an actual incident and the issues to consider in claims occurring on private land over which public rights of way have evolved.
