EL Trigger Court of Appeal impact
A Court of Appeal judgement on the Employers Liability Trigger Litigation may result in restricted access to compensation for some claimants. Public authority defendants may have to give back compensation or put aside provisions for unpresented potential mesothelioma claims.
On the 8th October 2010 the Court of Appeal handed down its judgement on the Employers Liability Trigger Litigation. It had been hoped this judgment would bring certainty to the question of which insurer should meet a mesothelioma claim resulting from historic asbestos exposure. Unfortunately, the Court of Appeal delivered a divided result (by a majority) to allow in part the appeal by the run-off insurers, creating even greater uncertainty and confusion over the interpretation of employers’ liability policies.
